My Best Buy® Terms

Thank you for reviewing the terms (“Terms” or “Rules”) for the My Best Buy® program (the “Program”). These Terms are between you and Best Buy Stores, L.P. and/or its affiliates (“Best Buy” or “us” or “we”) and govern our respective rights and obligations. You become a My Best Buy member by enrolling in or participating in the Program. The Program is also subject to our Terms and Conditions and Privacy Policy, as well as all other applicable terms, conditions, limitations and requirements. The Terms, together with applicable terms related to any promotional offers provided to you for use with the Program, constitute the entire agreement between you and Best Buy® related to the Program. If you have a My Best Buy Credit Card, please see My Best Buy Credit Card Account Terms for additional information. Best Buy may update or terminate the Terms and the Program at its sole discretion. If we make changes to the Terms or terminate the Program, we may notify you by email and/or post new Terms at BestBuy.com. You agree to any updates to the Terms by participating or remaining in the Program. 

THESE TERMS INCLUDE A BINDING ARBITRATION AGREEMENT, CLASS ACTION WAIVER, AND JURY TRIAL WAIVER THAT AFFECTS YOUR RIGHTS. IN ARBITRATION, THERE IS NO JUDGE OR JURY AND LESS DISCOVERY AND APPELLATE REVIEW THAN IN COURT. PLEASE CAREFULLY REVIEW THE DISPUTE RESOLUTION SECTION BELOW.

1.    Eligibility
A.   Age
Membership is open to individual U.S. residents (50 states, DC, and Puerto Rico) at least 13 years of age. If you are between 13 and the age of majority (18–21 years old), you may join the Program only with the permission of a parent or guardian.

B.   Email and Electronic Communications
You must provide and maintain a valid email address and promptly update your account with any changes, and you acknowledge and expressly consent to receipt of electronic communications from Best Buy about your membership in the Program and promotional offers.

C.   Participating Properties
Membership is valid at Best Buy retail store locations in the United States (50 states, DC, and Puerto Rico), BestBuy.com, the Best Buy mobile app, and other select Best Buy properties (together, “Participating Properties”). Please note that some products purchased at stand-alone Pacific Sales® Kitchen and Bath Centers, LLC stores or at Pacific Sales locations within Best Buy Stores are not eligible to get points toward My Best Buy reward certificates, and reward certificates may not be redeemed toward the purchase of certain products at those locations.

D.   Redemption Opportunities
Members may use points received under the Program toward the issuance of reward certificates and Best Buy promotional offers, or members may use them with Best Buy promotional partners we will identify from time to time (“Best Buy Partners”). We may identify certain products and offers which are ineligible for purchase with points or reward certificates. Reward certificates may be used at Best Buy retail stores, BestBuy.com, and the Best Buy mobile app (excluding those items described in Section 3 below).

E.    Receiving Points
Except for Non-Qualifying Purchases identified below, you may receive points for My Best Buy reward certificates on purchases for your personal use at any of the Participating Properties or with Best Buy Partners. However, we may identify certain products and offers that are not eligible for receiving points. Also, some products purchased at stand-alone Pacific Sales® Kitchen and Bath Centers, LLC stores or at Pacific Sales locations within Best Buy Stores are not eligible to receive points for My Best Buy reward certificates.

The following are excluded from receiving points (“Non-Qualifying Purchases”): Apple and Beats products and Apple services not purchased on standard credit with My Best Buy Credit Cards; transactions for leased products; purchases made prior to becoming a member; purchases/rentals at rent-to-own locations inside Best Buy Stores; purchases from a Best Buy Store on a third-party website or marketplace (such as Amazon, Google or eBay); purchases from third party sites operating on Best Buy’s behalf; transactions including instant rebates; pre-orders at the time of deposit (the points will be awarded at the time of final payment or at the time you pick up the product); purchases made for resale; purchases paid with a reward certificate; purchases involving promotional financing, purchases of Best Buy Gift Cards, purchases made with store credit issued by Best Buy; sales tax, donations, service charges or other excluded charges; certain Best Buy Business or commercial purchases; and certain exclusions in particular promotions.

Members receive 1% back in rewards on qualifying purchases (0.5 points for every $1 spent) at Participating Properties. Points will post to a member’s account 15–20 days from purchase date, shipment date, or delivery date. If you return an item in a qualifying purchase for which you received points, we will deduct the corresponding number of points from your account.

If you make a qualifying purchase without providing your My Best Buy member ID at the time of purchase, you may request points within 180 days of purchase at BestBuy.com/signin and selecting the “Report Missing Purchase” link, or by calling 1-888-BEST BUY (1-888-237-8289). You must have your receipt.

F.    Member Pricing
Member purchases of certain products and services (which may include Non-Qualifying Purchases) may be eligible for discounts or reduced member pricing at Best Buy retail stores, on BestBuy.com, and the Best Buy mobile app (“Member Pricing”). Member Pricing will be limited-time offers and subject to offer limitations communicated by us. For example, certain Apple and Beats products identified by us may be eligible for Member Pricing from time to time.

G.   How to Keep Your Account Active
To remain eligible for the Program, you must maintain an active account. Account activity means a qualifying purchase made with your My Best Buy membership, issuance of My Best Buy program points for incented actions (example: check-in), reward certificate redemption (in store or online), or self-issuance of a reward certificate where you select the reward certificate amount and issue it (“Account Activity”).

If your account is inactive for a period of 12 consecutive months, we will issue you reward certificate(s) in 250-point increments, and you will forfeit the right to any remaining points less than 250. If your account is inactive for 24 months, we will terminate it. You may return your account to active status at any point during the 24-month period by simply engaging in Account Activity. If you wish to be a member in the Program after you are terminated, you must create a new My Best Buy account. Use of your My Best Buy Credit Card may indicate Account Activity. See Section 4 below for details.

H.   Resellers
Resellers are excluded from the Program and from receiving points. If we mistakenly issue points for resale purchases, we reserve the right to deduct those improperly awarded points and/or to invalidate improperly issued reward certificates, as well as to terminate such accounts.

If you are found, in our sole discretion, to be a reseller, your account may be terminated in accordance with Section 8 below.

2.    Reward Certificates
For every 250 My Best Buy points you receive, you will be eligible to receive a $5 reward certificate. Reward certificates are coupons for discounts on future purchases at Participating Properties and may be redeemed only for a discount on purchase amounts equal to or greater than the sum of the reward certificate(s) presented for redemption, excluding “Non-Qualifying Redemptions” (see below). Reward certificates are not transferable and may be used only by the member to whom they are issued. Reward certificates may be used in conjunction with most other discounts or offers toward the purchase of products, not to exceed the purchase amount. Unless noted otherwise on the reward certificate, each reward certificate will expire 60 days from the issuance date. Reward certificates have no cash value, and no change will be given for reward certificate redemption. Reward certificates may be used only once. Reward certificates expire at 11:59 p.m. CT on the expiration date shown on the reward certificate.

3.    Non-Qualifying Redemptions
Except for Non-Qualifying Redemptions identified below, you may redeem reward certificates when the purchase value (excluding tax) exceeds the reward certificate amount. The following is excluded from redemption of reward certificates (“Non-Qualifying Redemptions”): Prior purchases; purchases of leased products; purchases/rentals at rent-to-own locations inside Best Buy Stores; purchases from a Best Buy Store on a third-party website or marketplace (such as Amazon, Google or eBay); purchases of Best Buy or other third party service contracts, extended warranties or protection plans; purchases from third-party sites operating on Best Buy’s behalf; transactions including: certain purchases at stand-alone Pacific Sales® Kitchen and Bath Centers, LLC stores, or at Pacific Sales locations within Best Buy Stores; purchase of Best Buy gift cards; purchases made for resale; payment on any My Best Buy Credit Cards; certain premium major home appliances and home theater products; any online transaction that contains the purchase of a Best Buy Gift Card; sales tax, service and other excluded charges; and discounted Best Buy Business or commercial purchases. Other exclusions may also apply.

4.    My Best Buy Credit Cards
My Best Buy Credit Cardmembers will receive 5% back in rewards (2.5 points for every $1 spent) on qualifying net purchases at Participating Properties made with a My Best Buy Credit Card when selecting standard credit. My Best Buy Visa® Cardmembers also receive 1 point for every $2 of qualifying purchases outside Best Buy or Pacific Sales® Kitchen and Bath Centers, LLC stores made with the My Best Buy Visa. In addition, certain limited-time promotions may be offered for purchases made outside Best Buy Properties that may enable Credit Cardmembers to receive additional points.

“Net Purchase” means any purchase of goods or services on the My Best Buy Credit Cards excluding: 1) refunds, returns and/or unauthorized transactions; 2) cash advances or balance transfers; 3) any purchase of a product that is functionally equivalent to cash or a cash transaction, including without limitation, wire transfers, money orders, bets, lottery tickets or casino gaming chips; 4) taxes and delivery charges; or 5) any annual fee or other fees paid on these cards.

My Best Buy Credit Cardmembers will have the ability to set up point banking to save points until you are ready to issue a reward certificate. Point banking will be terminated if your Credit Card account is closed, and banked points will be issued as reward certificates. Any remaining points less than 250 will remain in your My Best Buy account and issued in accordance with Section 2. 

5.    Partners
My Best Buy members may also get points by transacting with Best Buy Partners. Best Buy will identify such opportunities from time to time.

Points from a partner transaction will post to your account 4–6 weeks from your transaction. If you make a qualifying purchase or transaction with a partner and do not see your points posted to your My Best Buy account, please contact the partner because only the partner has the information needed to validate your point award. If applicable, the partner may validate that your transaction was eligible for points and, if valid, will send the applicable information to Best Buy so your points can be properly credited.

6.    Privacy Policy
The information you provide as a member of the My Best Buy Program will be handled according to the Best Buy Privacy Policy. If you are interested in learning more about Best Buy privacy practices, please contact Best Buy at 1-888-BEST BUY (1-888-237-8289) or visit BestBuy.com/Privacy.

Occasionally Best Buy may test new products, services or promotions. Some of these tests may have implications for My Best Buy members that may vary from the Terms as stated here. When different policies or terms apply, we will communicate that to you.

7.    Limitations
You may not transfer or assign your Program membership or any Program benefits. Only one Program membership will receive points in any one transaction. Membership cards, points, and reward certificates have no cash value and may not be transferred except as specified on BestBuy.com/MyBestBuy. Additional restrictions may apply to Best Buy employees.

8.    Membership Cancellation
You may cancel your membership in the Program at any time by email or phone (1-888-BEST BUY).

If your membership is cancelled (either by you or by Best Buy), you will forfeit any remaining points.

If your account has a negative points balance, we may immediately cancel or reverse any or all outstanding points as well as issued reward certificates.

We may not issue you any reward certificate(s) if we terminate your account because of conduct that we determine, in our discretion, violates these Terms or any applicable law, involves fraud or misuse of Program membership, or is harmful to our interests or those of another customer. We also reserve the right to deny future membership if we deem your conduct to violate these Terms.

Our failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of our rights.

We may, in our discretion, change these Terms, BestBuy.com Terms and Conditions, Privacy Policy, My Best Buy Credit Card Account Terms, or any aspect of Program membership at any time without notice. If any change to these Terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED MEMBERSHIP AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR MEMBERSHIP.

10.    General Program Information
The My Best Buy Program is brought to you by Best Buy Stores, L.P. BEST BUY, the BEST BUY logo, the tag design, BESTBUY.COM, MY BEST BUY, and other logos and taglines are the intellectual property of BBY Solutions, Inc., licensed to Best Buy Stores, L.P., and others under controlled conditions. Program Terms are void where and to the extent prohibited by law. Taxes may apply where required by law.

11.    Limitation of Liability
IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN BESTBUY.COM TERMS AND CONDITIONS, IN NO EVENT WILL WE OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, ARISING OUT OF OR RELATED TO THE PROGRAM. OUR TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE TOTAL AMOUNT OF THE QUALIFYING PURCHASE THAT IS THE SUBJECT OF THE DISPUTE. THESE EXCLUSIONS AND LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR MEMBERSHIP. THE LIMITATIONS SET FORTH IN THIS SECTION WILL NOT LIMIT OR EXCLUDE LIABILITY FOR BEST BUY’S GROSS NEGLIGENCE, INTENTIONAL, WILLFUL, RECKLESS, OR MALICIOUS MISCONDUCT, OR FRAUD.

12.     Dispute Resolution by Binding Individual Arbitration

ANY DISPUTE INVOLVING YOU AND BEST BUY OR ANY OF ITS AGENTS MUST BE RESOLVED THROUGH INDIVIDUAL ARBITRATION, EXCEPT AS FOLLOWS: 

  • ANY DISPUTE FALLING WITHIN THE JURISDICTIONAL SCOPE AND AMOUNT OF AN APPROPRIATE SMALL CLAIMS COURT MUST BE BROUGHT IN SMALL CLAIMS COURT ON AN INDIVIDUAL BASIS; AND
  • ANY DISPUTE TO SEEK TO ENJOIN INFRINGEMENT OR OTHER MISUSE OF INTELLECTUAL PROPERTY RIGHTS MAY BE BROUGHT IN ANY COURT OF COMPETENT JURISDICTION.

“Dispute” shall be interpreted broadly and cover any claim or controversy arising out of or relating in any way whatsoever to your relationship or interaction with Best Buy, its agents, and its present and future subsidiaries, affiliates, and designees — including, but not limited to, GreatCall, Lively, Geek Squad®, Magnolia®, and Pacific Sales — whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory. Examples of relationships or interactions giving rise to a covered claim include, without limitation: (1) your use of Best Buy’s websites; (2) your membership in any Best Buy loyalty or rewards program (e.g., My Best Buy®) or subscription-based services (e.g., Best Buy Totaltech™); (3) your receipt of delivery, repair or installation services or consultation services provided by Best Buy or its agents; (4) any communications between you and Best Buy; (5) application for financing; and/or (6) your purchase of products or services offered, sold, or distributed by Best Buy including, but not limited to, any Dispute arising from the advertising of, or the sales practices related to, such products and services. If you are a My Best Buy® member, Dispute shall also include all disputes that arose before your enrollment in, and after the cancellation or termination of, the My Best Buy® program, including any claims that are the subject of a purported class action litigation.

BY AGREEING TO ARBITRATION, YOU UNDERSTAND AND AGREE THAT YOU ARE WAIVING YOUR RIGHT TO MAINTAIN OTHER AVAILABLE RESOLUTION PROCESSES, SUCH AS A COURT ACTION OR ADMINISTRATIVE PROCEEDING, TO SETTLE DISPUTES. THE RULES IN ARBITRATION ARE DIFFERENT. THERE IS NO JUDGE OR JURY, LESS DISCOVERY, AND LIMITED APPELLATE REVIEW. ARBITRATORS CAN AWARD THE SAME DAMAGES AND RELIEF THAT A COURT CAN AWARD.

Before either Party may initiate an arbitration proceeding, you and Best Buy agree to engage in a good faith effort to resolve the Dispute informally for 60 days, unless that time is extended by agreement. If you intend to initiate an arbitration proceeding, you must first send a fully completed notice of your Dispute (the “Notice”) to Best Buy. The Notice must include your name and contact information (address, telephone number, and email address) and information sufficient to enable Best Buy to identify any transaction at issue. The Notice must also include a detailed description of (1) your Dispute; (2) the specific facts supporting your claim(s); (3) the nature and basis of the damages you claim to have suffered; and (4) a calculation and explanation of the relief sought. Your Notice shall be personally signed by you and sent to Best Buy at CT Corporation System, Inc., 1010 Dale Street North, St. Paul, MN 55117-5603 or by email at Arbitration@BestBuy.com. If Best Buy intends to initiate an arbitration proceeding, it will send a Notice to you at the contact information we have on file. If requested by Best Buy as part of this mandatory informal dispute resolution process, you agree to personally participate (along with your counsel, if you are represented) in a telephone conference to discuss the potential resolution of the Dispute between you and Best Buy. If the Dispute is not resolved within 60 days after receipt of the Notice (or the longer period agreed to by the Parties), you or Best Buy may proceed with individual arbitration (this informal process is a condition precedent to doing so). If the sufficiency of a Notice or compliance with this mandatory informal dispute resolution process is at issue, it may be decided by a court at either Party’s election, and any formal dispute resolution proceeding shall be stayed pending resolution of the issue. A court shall have the authority to enforce this condition precedent, which includes the power to enjoin the filing or prosecution of a demand for arbitration. The statute of limitations and any filing fee deadlines shall be tolled while the Parties engage in this informal process.

If the Parties are not able to resolve the Dispute through the mandatory informal dispute resolution process referenced above, either Party may initiate an arbitration proceeding by sending a demand to the American Arbitration Association (AAA) that describes the nature and basis for the claim and includes all of the information required in the Notice. The Party initiating arbitration must include as part of the demand a personally signed certification of compliance with the informal dispute resolution process. You may serve a copy of a demand on our registered agent CT Corporation System, Inc., 1010 Dale Street North, St. Paul, MN 55117-5603. The arbitration will be governed by the AAA’s applicable Consumer Arbitration Rules or Commercial Arbitration Rules (collectively, the “AAA Rules”), as appropriate, and as modified by these Terms, and will be administered by the AAA. The AAA Rules and the form for filing an arbitration claim are available at www.adr.org. If the AAA is unavailable or unwilling to administer the arbitration consistent with this Dispute Resolution section, another arbitration provider shall be selected by the Parties that will administer the arbitration consistent with it.  If the Parties cannot agree on a provider, one shall be selected by a court that will administer the arbitration consistent with this Dispute Resolution section.

Payment of all filing, administration and arbitrator fees will be governed by the AAA’s Rules; however, Best Buy will consider reimbursing the consumer portion of the AAA fees upon a showing of financial hardship.

The Parties shall be responsible for their own attorney’s fees and costs in arbitration, unless they are authorized by law or the arbitrator determines that a claim or proceeding was frivolous or brought for an improper purpose or in bad faith (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)). The arbitrator shall apply the provisions of Federal Rule of Civil Procedure 68 after entry of the award. 

You may choose to have the arbitration conducted by telephone, virtually, based on written submissions, or at an in-person hearing in the county where you live or at another mutually agreed upon location. Best Buy reserves the right to request a hearing from the arbitrator. You agree to personally appear at any in-person hearing (along with your counsel if you are represented).   

YOU AND BEST BUY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING. THIS MEANS THAT YOU MAY NOT PURPORT TO ACT ON BEHALF OF A CLASS OR ANY OTHER PERSON. The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim. The arbitrator may not award relief for or against anyone who is not a party to the arbitration proceeding. Further, unless both you and Best Buy agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding. If a court determines that a claim for public injunctive relief may not be waived and all appeals from that decision have been exhausted, then the Parties agree that any claim for public injunctive relief shall be stayed pending arbitration of the remaining claims. If this specific paragraph is found to be unenforceable, then the entirety of this dispute resolution provision (except for the jury trial waiver) shall be null and void.

This paragraph sets forth additional procedures that apply to mass arbitrations. If twenty-five (25) or more similar claims are asserted against Best Buy by the same or coordinated counsel or are otherwise coordinated, you understand and agree that these additional procedures apply and that the resolution of your Dispute might be delayed.  Counsel for the claimants and counsel for Best Buy shall each select fifteen (15) cases (per side) to proceed first in individual arbitration proceedings as part of a bellwether process. Each of these thirty (30) cases shall be assigned to a different arbitrator. The remaining cases shall not be filed or deemed filed in arbitration nor shall any AAA fees be assessed in connection with those cases until they are selected to proceed to individual arbitration proceedings as part of this bellwether process. If the Parties are unable to resolve the remaining cases after the conclusion of the initial thirty (30) proceedings after conferring in good faith, each side shall select another fifteen (15) cases (per side) to proceed to individual arbitration proceedings as part of a second bellwether process. Each of these thirty (30) cases shall be assigned to a different arbitrator. The remaining cases shall not be filed or deemed filed in arbitration nor shall any AAA fees be assessed in connection with those cases until they are selected to proceed to individual arbitration proceedings as part of a bellwether process. A single arbitrator shall preside over each case. Only one case may be assigned to each arbitrator as part of a bellwether process unless the Parties agree otherwise. Identical sets of arbitrators shall not be assigned to sets of bellwether proceedings. This staged process shall continue with thirty (30) cases in each set of bellwether proceedings, consistent with the parameters identified above, including that the remaining cases shall not be filed or deemed filed in arbitration nor shall any AAA fees be assessed in connection with those cases until they are selected to proceed, until all the claims included in these coordinated filings, including your case, are adjudicated, settled, or otherwise resolved. The statute of limitations and any filing fee deadlines shall be tolled for claims subject to these additional procedures that apply to mass arbitrations from the time of the first cases are selected for a bellwether process until the time your case is selected for a bellwether process, withdrawn, or otherwise resolved. You and Best Buy agree to engage in this process in good faith. A court shall have the authority to enforce this paragraph and, if necessary, to enjoin the mass filing or prosecution of arbitration demands against Best Buy.

If for any reason a claim may proceed in court rather than in arbitration, WE EACH WAIVE ANY RIGHT TO A JURY TRIAL, UNLESS SUCH WAIVER IS UNENFORCEABLE. THIS MEANS THAT ANY CLAIM WOULD BE DECIDED BY A JUDGE, NOT A JURY.

This dispute resolution provision shall be governed by the Federal Arbitration Act. It shall survive any termination or cancellation of, or your participation in, any membership programs or subscription services and your relationship with Best Buy. Any amendments to this dispute resolution provision shall not affect any then-active or pending arbitration proceeding.

13. Applicable Law
THE FEDERAL ARBITRATION ACT AND APPLICABLE FEDERAL LAW (OR IN THE ABSENCE OF APPLICABLE FEDERAL LAW, THEN THE LAWS OF THE STATE OF MINNESOTA), WITHOUT REGARD TO PRINCIPLES OF CONFLICT OF LAWS, WILL GOVERN THESE TERMS AND APPLY TO ANY DISPUTES AGAINST BEST BUY.
