Open box=broken?

Luckily I was able to return it, but I am kind of confused about what made them think the product was in a sellable condition.

Everything else is as good as you'd imagine, but this one stupid quirk makes it unusable, for me at least. Explanation: This thing has a low-level 'feature' that disables the trackpad and keyboard anytime the gyro detects it's not flat. Lenovo and dell and others only disables the keyboard and track pad when in tablet mode only. However, Asus in their infinite wisdom added an extra driver/bios level "feature" that ALWAYS disables touch pad and keyboard regardless of laptop or tablet mode and it cannot be disabled. This means whenever the laptop is past 30-45 degrees angle wise, it'll disable. So forget about using it bed, on the couch, tilting it to show someone something, or anything that isn't on a desk.
