Ear buds come out of your ears. Microphone is poor

It doesn't work

It worked the first day and then ran out of charge. When I charged it, I tried it again and it worked for a few minutes and then stopped working all together. The red light turns on when I charge it but it doesn't turn on at all anymore when I press on the power button. Not sure what happened. I no longer have the receipt or the box so I'm wondering how I can return it.
