Usually no unless you bought the phone under a program like AT&T Next installment plan. If you used the Next plan then you will be required to pay the full balance on the phone. If you bought the phone under a contract then no you don't have to return the phone. You will have to pay early termination fee. If you want to use the phone on a different network other than the company you originally had the contract then you will have to have the phone unlocked.
