New. They must say if refurbished. So if you do not see refurbished, then they are new. I personally know they are new because I bought 2

They seem to be new. I believe since the studio 3’s are currently coming out, that the $159 price is to clear the selfs and warehouse of the Studio2’s so people will buy the higher priced studio3’s. I bought a pair for my teen daughter. I inspected them, even tried them out. Definitely seem new.

I’m not sure if Apple will do the insurance. Since they were only $159 I didn’t try to get any

Mine were brand new for $159. You can buy used or refurbished if available it will say something like open box available. Those may even be cheaper.
