When initially powered on the battery icon and charge status shows Red and low % after several minutes you will finally get the true battery charge indications. Bought it for music use only in the gym so the correct state of battery charge is important to me albeit not important enough to contact Apple, to much of a hassle if I would have needed to return it, so I lie with it.
