Even though it was not in its original box the headset is brand new. All parts and documentation was with it. Sounds great like a high end Beats should at a great price!

It could be the 'operator' and not the product, but I couldn't turn it off last night so I had to let it die over night. I will recharge again and try again, but I think I will have to exchange.
