I took it back to the store to get a new one and had the same problem. I immediately returned to the store for an exchange and asked for assistance. An employee assisted me and also stated that the screw was unable to hold the ball (think joint and socket). I eneded up getting a refund and moving on to anmore expensive tripod.

I tried propping the stick up however even then the weight of the cell phone holder consistently would not stay in place under the weight of the phone.
