I have gone through two pens with the same problem. I am not sure what the issue is, would go through troubleshooting steps. the buttons would work but inking wouldn't. When it did work it was excellent, but I ended up getting the slim pen and a third party pen to use with my surface.

Surface Pro Pen

The surface pen feels so smooth when writing / sketching on the Surface pro tablet. The pen does have some weight to it compared to the new model. But this pen is still fantastic. If you catch this pen on sale I recommend that you get one!
