Is this phone new and guarateed so? null

No this iPhone was opened by a best buy associate before i got to the store and the sim card was already activated. When checking my ATT account it showed that there was a ZTE Z982 attached to the new line that came with the new phone. I also was not provided a valid receipt ( it had a date of January 1, 0000)
