“I'm trying to buy this phone with the plan but everytime I click on add package it's brings up this pop up for current at&t users I am not one so do I have to be one to buy this item, it's a bit frustrating”

Yes, you can only buy through Best Buy by signing up with a provider. You can go to Apple and purchase but you will still need to select a carrier. If you buy and sign up for a plan but prefer to pay for your phone in full you can do it on your first bill from your carrier.
