If this 28 " TV does not fit the space can I get a refund? null

At time of purchase, we were told if it did not fit our cabinet opening, we could return it for a refund. It fit perfect, however the picture would flutter for a few minutes when first turned on, then quit the screen flutter after approximately 10 minutes. I returned it for a replacement, with no problem. Best Buy has great service.
