“At work I am allowed to have one earbud in my ears at a time so I can hear what's going on around me, is there a way to have one charging and the other in use so I can switch back and forth and always have one charging? This is kinda a deal breaker.”

No. You can use the left one by itself but not the right side. The left side controls the power of both sides. So if it's off so is the right side.
