• I bought one on Friday and it was brand new. I had no problems switching my old device to this new device by going using the verizon prepaid app. I also didn't have to pay another monthly plan payment because I had already paid up until Dec 11th on my old plan.

• Yes. These are brand new. I was worried about the same thing initially. At Verizon this same phone was about $100 more.
