Won't stay running for more than 15 seconds!

I just purchased this tonight, was super excited because I just to have a different B&D model that broke after being dropped but this is nothing close to the one I used to have. I took it out of the box and charged it before using it. When I finally did turn it on, it stayed running for 20 seconds, but after that, each time the on and off button was switched, the time it stayed running got shorter and shorter. Going to return this first thing tomorrow morning and hopefully the $25 battery fee (which I think is RIDICULOUS!) can be void due to the vacuum's defective battery.
