Brand New Washer Fail?

After the second day we called Best Buy and they transferred me to Whirlpool and Whirlpool set up an appointment with a local repair shop, but failed to let the repair shop know about the appointment. Eventually the repair shop came out and found that the brand new washer failed 2 out of the 3 test they ran. It will take at least a week to get replacement parts, but this is a brand new washer. Should it need it?

Its top loader and wint let you lift the lid if you forgot the soap or forgot to put something in. It will drain all the water out and make you start cycle again. If you soak a load then want the load to start the wash cycle it will dump the water and refill. We are in freaking drought in Ca this is not energy or water efficient.
