The FitBit company is VERY responsive to emailed questions or you can call them too. They do guarantee against certain things.

When you touch it, does it vibrate? Mine did that the other day and I had only had it one month. I ran it to Best Buy and it was asleep. The sales tech just touched something and it went from black, back to life. (It was black, but vibrant when I touched the side, button, but nothing turned on,)
