• I'd assume it's NEW otherwise it would be clearly marked (Refurbished), I have one and it a very nice device for a surprisingly affordable price.

• I can only presume BestBuy themselves could answer that, in store. Typically everything is NEW, unless it is noted as open box or returned. Have never gotten a USED item, via BestBuy.com
