No. It will either use data from your phone or it will pick up WiFi when available.

No and At&t tried to pull one over on me. If you get it through them, they will say you need to purchase a 10 / month plan. The watch can be used without a phone. Even if you use it with a phone, it doesn't use any data as it's all bluetooth.
