Did Comcast promise you or did they said that you can go up to 400? Two different things. They probably want to rent theirs. Also, are you connect directly from the wall or wireless. Wireless is going to be slower.

It's easy for them to blame it on the modem since you are using something outside of what they provided you with. I have the same modem with my spectrum service (400 down 20 up) and I'm averaging 475 down and 25 up. It's consistently fast with an average latency of 10ms.
