It's up up to Apple which resellers get access to specific hardware. To get an unlocked iPhone just go directly to Apple/apple.com. I'd like to be able to buy one from Best Buy as well, but it does not look like they offer it currently. Best Buy has been known to eventually sell a specific model unlocked; especially after the initial launch.
