yes. but once the new phone is activated, their older phone might shut off for a minute and might not work after but they do not have to be with you to get the upgrade as long as you're the primary user on the account

Samsung has smart switch app which makes transfer of files seamless. If your son's phone is backed up by icloud, he can do the same.
