Call Fitbit and explain the problem. They know there is a pairing problem. Have your receipt handy when you call unless it was a gift. They sent me a new device. You have to use everything you got with the original, ie; watchband & charger. They were very nice about it.

Also it may be the phone you have is not compatible with the fitbit 3 app. One more very important thing, have you installed the fitbit app onto your phone? To answer your question, yes they should take it back. I purchased one for my dad last year at christmas and it didn't work out for him. He called them up explained his problem and they refunded him his money and took it back without any problems.
