• Not from at&t. Some stores offer it, but they have been sold out for a while.

• No as of now it must be purchased on AT&T with a plan but you can pay for it outright. It will be locked to AT&T for 90 days from activation date. From what I've observed and just experienced it has to be purchased as a add a line.
