This cooler is for Beverages only, not made for food storage, that is why it only goes to 40 degrees. 40 degrees is optimum for beverages. I would return it if you planned on using it for food storage and I would get an actually mini Fridge.

I have the 48-can version of this Insignia Beverage Cooler, set on 40 (as I only have beverages in there and don't need to set it lower -- and haven't tried), and it reads 40 exactly on my refrigerator-freezer thermometer I always keep in there (a "Taylor 5924"). I also keep these in my MAIN refrigerator in the kitchen (one 5924 is in the refrigerator section and a second 5924 is in my freezer section). Make sure you have a decent thermometer (these Taylors seem to be accurate) to be sure the temp you're seeing really is 40. But if you have the unit in a house (not outside in the hot sun or hot garage) and it won't go below 40, something is wrong.

So I just think of whatever you set it at is an "average" temp (if you will) as I'm not seeing the exact same temp everywhere I put my thermometer. I think that's just the way ALL these units are -- even the "dorm refrigerators" (that don't have glass doors) Insignia and other brands make. Of course, I'm no expert, so that's just my opinion.
