From the many different independent reviews I've read on other sites. It seems that pedaling IS required to reach 28 MPH. Pedaling triggers the cadence sensor which tells the motor to go top speed. Having said that I don't own the bike myself and can't verify this in anyway. Although I do hope to one day buy one.

I weigh 228 pounds and was able to reach 26MPH on level road, but it required very fast pedaling. Practically, 24MPH is the fastest usable speed for my weight. Throttle maximum speed will always be 20MPH, it’s the law.
Sorry, there was a problem. Please try again later.You have to change it in the display using the buttons on the handle bar. Classes are 0 - 3. 0 being manual no assist. To get 28mph you have to change to class 3 in the display and use pedal assist. No "unlocking" needed.
Sorry, there was a problem. Please try again later.I'm 250lbs and I can get mine going 28mph all the time very easily. Put it in 3 let off the thumb throttle and just pedal only. There will be no resistance at all in the pedals. You can literally just sit down and just move the pedals to go. No need to use the thumb throttle at all. Downside is you will use up a lot of battery power if you go full speed all the time,but it takes all the work out of it. Going down hill I've gotten mine to go 39.8mph. Super fun
