They are not OSHA approved. They are also not against OSHA rules like head phone are. It comes down to your employer if they allow them or not.

According to the Osha.gov website, "there is no specific OSHA regulation that prohibits the use of headphones on a construction site." These are open-ear headphones, allowing you to still hear your surroundings. We kindly ask that you reach out to your employer directly to learn of their headphone policy.
