Is Happy Birthday one of the programmed songs null

To the best of my knowledge "Happy Birthday" is a currently copyrighted song. As such, technically, you are in violation of the copyright every time you go to a birthday party and sing it. I have heard of incidents when the copyright holder has brought suit. Therefore, it ought not to be programed into the instrument unless given permission by the copyright holder.
