Open box new or refurbished?

It seems pretty often recently that it sends out refurbished AirPods Max as open box new. I bought three open box new but they all had stains and about 6 months Apple warranty left. One of those got confirmed by Apple that was Bestbuy-refurbished and it didn’t do the job right. There is a mismatch of the left and right pod.

However the noise cancelation and sound features on this product are awesome but not worth the price tag and to be uncomfortable.
