A: It absolutely has to be new unless otherwise stated. I'm pretty sure there's laws against selling used anything as new. If that's ever happened buying from a retailer you have a legitimate complaint.
Q: Does this work with boost mobile?
A: Boost mobile is a service provider. If your phone is unlocked I imagine it would work with any of them.
