Maybe not. I had an AT&T Unite that went out of warranty and was acting up. The SIM card did not fit into my new AT&T Unite Explore. So, I had to call AT&T and activate the device on my data plan using the Explore's IME ID, etc. And, yes, there was an activation fee. However, because I paid $199.99 for the device, I did not have to commit to a two-year contract.
