Sorry, there was a problem. Please try again later.I would expect it to be warranted for a year, but best talk to your BestBuy distributor. Where is it getting its power from? If its coming from a USB on the computer, then clearly the computer is on so its not unreasonable that the cooling pad would be running. As far as I am aware, there is no thermal switch to determine if the cooling pad should be active or not. If power for the cooling pad is coming from a USB converter from mains 110V power, then I would expect the cooling pad to be on as long as it is plugged in. The cooling pad I have is simply a blower that blows air from underneath its self to the underside of the laptop, then the air blows out sideways, thus cooling the exterior of the laptop and providing a source of cool air for the internal cooling system or fan.
