Hard to say. I think the developers just found a publisher that was willing to take the risk of publishing it in large quantities in the US. Sort of like the Blaster Master Zero series. Pre-ordering/purchasing these was done via Limited Run only in the US, but you can buy them publicly in Japan. Unless it is a proven franchise, most publishers won't take the risk to mass produce an "Indie" title. As for the art book, the developer normal has copyright rights to material used in this manner. So it wouldn't surprise me if it is indeed the same book.
