Labels warning that a product contains chemicals that may cause cancer, birth defects, or reproductive harm are now required on many household items sold in California. But people all over the country might see them because many companies put the labels on all items that contain these chemicals, even if they’re going to be sold in other states. Products that are sold outside of California are not required to have the warning label even if they contain substances that might cause cancer. Some companies that sell products all over the US only label those sent to California, even though all their products contain the same compounds. Businesses will still label a product in the event that it will end up in California. The penalties for not complying with Proposition 65 are high. As a result of the potential penalties and because there is no penalty for providing an unnecessary warning, many manufacturers, have elected to provide the Proposition 65 notice out of an abundance of caution in order to avoid the potential for liability...^IFV
