“IS it okay to set on a counter with a top clearance of 3 inches and the sides are open and the back would be against a back spash so after the height of the backsplash it would have an inch or so extra space.”

I wouldn't do that. The top and sides get pretty warm. I don't know that it would burn your hand but it feels hot.
