That will depend on what you receive, but the 870 evo wasnt even released until 2021, and it's unlikely to have passed through samsung's warranty database. It's very likely that you're just getting someone else's buyers remorse return. Between BBs return window and the evo line carrying a 5 year warranty, you should be fine. You should also check the SMART status for total writes. This line has a HUGE write life expectancy compared to most SSDs, so again, you should receive a drive <1 year old and with 99% write life remaining. I went for it and received exactly that. For extra insurance, go to Samsung's site and do a warranty check on the serial number while still in BBs return window.
