“Does this case fit the Surface pro 9 correctly? Biggest problem I've seen is the power button is on the top on the 9 instead of the side like the 8 which has made alot of cases not work right.”

It fits on my Surface Pro 9 perfectly. The power button cover is on the top. Of course, you will want to make sure that the model you get says it is for the Surface Pro 9.
