Can not run any games above 60 fps.

I loaded up the new warzone and can’t play without the game crashing every 30 seconds. Fortnite runs at a consistent 40-60 fps. I don’t know if I have to change something on my end or what but as of now I’m stuck with a $5200 paper weight.

Based on your description of the issues, and the configuration, it may be as simple of a matter as connecting your display to the correct video port.
If the display is connected to a video port near the top of the system, among the various USB, audio, and networking ports, then it is not connected to the GeForce RTX 3090 Ti graphics card, but instead the lesser graphics capabilities of the motherboard and processor combination.
Please make certain that the display is connected to one of the video ports near the middle of the PC, and found in a horizontal row.
