Binding Agreement: By participating in Best Buy’s Trade-In Program offered in store or on the www.bestbuy.com website (which will be referred to as the Trade-In Program in this agreement), YOU AGREE TO BE BOUND BY THESE TERMS & CONDITIONS (EXPLAINED BELOW) AND THE BESTBUY.COM CONDITIONS OF USE. The www.bestbuy.com website, Best Buy mobile and iPad apps, and our mobile Best Buy site are collectively the "Best Buy Properties" and each individually is a "Best Buy Property." It is your responsibility, prior to participating in this Trade-In Program, to read these Terms & Conditions carefully to understand your rights and obligations. If you are dissatisfied with any Best Buy Property, its content, or these Terms & Conditions, you agree that your sole and exclusive remedy is to not participate in the Trade-In Program.

Best Buy: References to "Best Buy," "our," "we," or "us" may refer to Best Buy Co., Inc., BestBuy.com, LLC, Best Buy Stores, L.P., BBY Solutions, Inc., Best Buy Enterprise Services, Inc. and their affiliates, subsidiaries, and designees.

Changes: Best Buy reserves the right to make changes to any Best Buy Property and these Terms & Conditions at any time. Each time you wish to participate in the Trade-In Program, you should review the then-current Terms & Conditions. Best Buy may terminate the Trade-In Program at any time, without notice to you.

Rights and Obligations Regarding the Trade-In Program: You agree to the following terms and conditions:

1. Ownership and Authority to Trade-In. You represent and warrant that you are the sole and rightful owner of the item bearing the specifications, serial number, and model number which you have offered for trade-in (the "Item") and have full authority to sell or otherwise dispose of the Item. You further represent and warrant that (1) you have the power and authority to enter into this agreement; (2) the Item(s) is (are) not counterfeit or stolen; and (3) the Item(s) does (do) not violate any law, statute, ordinance, or regulation.
2. Deactivate. You agree to deactivate all services to your Item(s) and remove any and all codes (including without limitation removing user locks, passwords, and/or turn off/deactivating the “Find My Device” feature) that may prevent Best Buy from having the ability to use, refurbish, recycle, resell or dispose of the Item.
3. Accuracy of Information. You agree that all information you provide about the Item for trade-in, as well as information you have or will provide about yourself, is true, accurate, and complete.
4. Original U.S. Equipment from Manufacturer. Best Buy reserves the right to deny a trade in for products that were originally sold primarily in markets outside the United States, or for equipment that does not contain all original equipment manufacturer parts and/or serviced by the applicable manufacturer or approved service provider.
5. Working Condition Upon Arrival. You agree that you are providing the Item to Best Buy in working condition, and you shall be solely responsible for the arrival condition of the Item at Best Buy's facilities. It is important that you carefully package the Item to ensure that the Item is delivered to Best Buy without damage as those damages are your responsibility.
6. Items Inconsistent with Provided Description. If Best Buy provides notification that your description of the Item was inconsistent with Best Buy’s evaluation of your Item, you will be provided with an updated quote of trade-in or credit value. You may elect to either trade in your Item for the updated quoted trade-in or credit value, or you may elect for the Item to be returned to you. If Best Buy determines that the Item has no trade-in value, Best Buy may recycle the Item without compensation to you or, if you elect for the Item to be returned to you, Best Buy reserves the right to require you to provide a prepaid shipping label. To have the Item(s) returned to you, you must promptly respond to Best Buy’s email within 72 hours of being contacted. If you do not respond within this time period, we will presume that (1) the updated trade-in value option is elected, and the Item will be processed using the updated value; or (2) if the Item has no trade-in value, then Best Buy may recycle the Item. If we receive an item that is a biohazard or is considered hazardous (ex. bodily fluids on items, swollen lithium battery, etc.), we will not ship the item back to you and we will dispose of the item(s) in accordance with federal regulations.
7. Limitations. You acknowledge and agree that Best Buy may, in its sole discretion, reject or limit the quantity of Items to be Traded In under the Trade-In Program regardless of where the trade-in occurred. Our Trade-In Program is for the personal, non-commercial use of our retail customers. Best Buy reserves the right to limit Customers to trade in no more than five (5) of the same, or similar, product per month. These product limits are subject to change at any time. Please note that there may be additional product limits associated with promotions. We reserve the right to refuse any trade-in or limit quantities for any reason at our own discretion.
8. Final Determinations. If Best Buy rejects an item(s) because you have exceeded Best Buy’s limit on the number of items that you may trade in Best Buy reserves the right to (1) recycle the item without compensation to you; (2) require you to provide a prepaid shipping label; or (3) properly and responsibly dispose of products that are deemed HAZMAT. You agree that all determinations of Best Buy with respect to trade-in and credit value assigned to the item after its inspection are made in Best Buy’s sole discretion, will be accepted as final, and are not negotiable.
9. Prompt Shipment and Promotional Offers. You agree to ship the Item to the address provided so that it arrives within 14 days of accepting the estimate. If the Item is not received within 14 days of the date on which the estimate was provided to you, then Best Buy has the right to revise or withdraw the estimate for the trade-in or credit value of the Item. In addition, any promotional offers may no longer be valid, depending on the terms of the promotional offer, if the Item is not received by Best Buy within 14 days of the date on which the estimate was provided to you. The terms and availability of promotional offers may vary between the Trade-In Program and participating stores.
10. Costs of Packaging and Shipment. Best Buy will provide you with a prepaid shipping label for the shipment of your Item to Best Buy. You agree that you are solely responsible for all costs associated with the packaging of the Item for shipment to Best Buy and, if applicable, the shipping and handling costs to return the Item to you.
11. Loss or Damage to the Item and Its Contents. You agree that Best Buy, its parent company and affiliates, will not be responsible under any circumstances for any loss or damage to the Item. In addition, you acknowledge that it is your sole responsibility to remove all personal data (e.g., files, photos, videos, music, etc.) from the Item (e.g., PCs, laptops, wireless phones, Smartwatches, etc.). You agree that Best Buy, its parent company and affiliates, are not responsible for the loss or destruction of the hardware, software, files, or media containing any personal data left on or in the Item. You understand and agree that you will not be able to recover any data or files stored within the Item.
12. Transfer of Ownership. Upon receipt and acceptance of the Item by Best Buy, you hereby agree to transfer all right to and title in the Item to Best Buy, in exchange for the trade-in or credit value quoted to you.
13. Final Transaction. No Rescission. You acknowledge and agree that the trade-in transaction is final and cannot be cancelled or rescinded by you after your Item is received by Best Buy, unless Best Buy contacts you to provide notification that your description of the Item was inconsistent with Best Buy’s evaluation of your Item.
14. Release of Liability. To the extent permitted by applicable law, you hereby release Best Buy, its parent company and affiliates, from and against any liability arising out of or related to the transfer of the Item, including but not limited to any liability related to the shipment of the Item, the deletion or non-deletion of any data or files from the Item, the evaluation and assessment of the Item (and the corresponding trade-in valuation) made by Best Buy, and the non-availability of the Item after it has been accepted by Best Buy.
15. Reporting and Sharing Information. Best Buy may be required to share personal information in response to a valid court order, subpoena, government investigation, or as otherwise required by law. You acknowledge that Best Buy reports information regarding the trade-in transaction, including your personally identifiable information, to law enforcement agencies and electronic reporting services used by law enforcement and government agencies in those jurisdictions in which it is required by law to report, and engages in voluntary reporting of certain information in other jurisdictions. For more information on our privacy practices, please review the Best Buy Privacy Policy located at BestBuy.com/privacy. We may call you at the number you provided regarding your trade-in transaction. Calls may be live or pre-recorded and made via automated dialing system. By providing your number, including a wireless number, I consent to Best Buy contacting me. Voice and data rates may apply.
16. If you are an Upgrade+ customer and are submitting your device financed with your Citizens Pay Line of Credit then the following terms apply: (1) in exchange for the Best Buy gift card that Best Buy will issue to you in an amount representing the value of your traded-in device, you agree that you, not Best Buy, will be responsible for the final payment due in month 37 for your Citizens-financed device, and (2) any option to directly finance the purchase of your new device will only be available through the Trade-In program, not through Citizens. By submitting your trade-in you agree to such terms. If you do not agree to such terms then do not continue with the trade-in process.

If you are dissatisfied with the Best Buy Web site, its content, or these Terms & Conditions, you agree that your sole and exclusive remedy is to not participate in the Recycling Program.

2. Limitations. You acknowledge and agree that Best Buy may, in its sole discretion, reject or limit the quantity of Items to be recycled under the Recycling Program.
3. Costs of Packaging and Shipment. Best Buy will provide you with a prepaid shipping label for the shipment of your Item to Best Buy. Depending on your device, you may also receive a return kit to mail in your device. You agree that you are solely responsible for all costs associated with the packaging of the Item for shipment to Best Buy.
4. Loss or Damage to the Item and Its Contents. You agree that Best Buy, its parent company and affiliates, will not be responsible under any circumstances for any loss or damage to the Item. In addition, you acknowledge that it is your sole responsibility to remove all personal data (e.g., files, photos, videos, music, etc.) from the Item (e.g., PCs, laptops, wireless phones, DVD/CD players, memory cards, iPods, MP3 players, etc.). You agree that Best Buy, its parent company and affiliates, are not responsible for the loss or destruction of the hardware, software, files, or media containing any personal data left on or in the Item. You understand and agree that you will not be able to recover any data or files stored within the Item, or the Item itself.
5. Release of Liability. To the extent permitted by applicable law, you hereby release Best Buy, its parent company and affiliates, from and against any liability arising out of or related to the transfer of the Item, including but not limited to any liability related to the shipment of the Item, the deletion or non-deletion of any data or files from the Item, and the non-availability of the Item after it has been accepted by Best Buy.
