The problem is as follows: With any AT&T locked device, they will be able to monitor what you do on the device. I suggest calling AT&T and telling them to "UNLOCK" your device (It is now legal and approved by the US Gov) and then you should be able to tether from it.

Seriously, you can have the folks at BestBuy look up your AT&T account and they are great at explaining what you have and can help you to upgrade, too!
