“Hi: we have a brand new Kitchen Aid replacing our beloved SubZero. The fridge side is sitting between 40/41 and we cannot get it any lower. Very frustrated that NO ONE can tell us how to make the Fridge 37 degrees as promised in literature.”

Call for factory service. Do not settle for anyone else's service. The unit is new, you can get factory service free of charge, Call Kitchenaid but do so at 8:00 am EST. If you call later they are tough to get on the phone. Your assumption is correct. Our refrigerator side is 36 degrees.
