“I'm thinking of this for a gift for my nephew who is temporarily living in France. Is Mario Kart pre loaded or do I have to download it before travelling over?”

I have bought 2 of these for my nephews....the 1st one I purchased I had to download it. Then he dropped it. I returned it with the the geek squad protection. The 2nd one was pre-loaded so you may need to open it and set it up to see before shipping it off.
