The case is not water proof but the earphones are . 
If your case ends up in water then you obviously know you were going to ruin them eventually so you got the insurance and can replace the case for a refurbished one .the earphones ate wp up to 30 meters

No. Gap on top and a hole on the side so you can see the charging light. Also, another hole on the bottom to allow the carabiner to attach.

I haven't dropped it in water, but it doesn't seem like a case that's open on top would be waterproof for very long. Also, I cut off the rubbery charging port cover under the plastic case so I could plug in a charging cable.
