• You can. I did Att next with this phone. Walk into a best buy store with mobile experience and they can take care of it.

• Probably because you started a 2 year contract after the AT&T next program was available.

• I don't see why you cant. I just upgraded to that exact phone this week on the AT&T Next plan though Best Buy.com. Perhaps you aren't far enough into your current contract to upgrade yet?
