• I believe you will have to pay the 10 months on your phone up front but then you can get the new phone for the current price.

• If you have the Edge plan (the month to month payment plan) and you have paid 50% of the cost of the device, and return the fully functional device to Verizon then you should be able to upgrade. You should be able to check the status on the Verizon site.
