Preorders will open when the device gets approved by the FCC. You can click “Notify Me” for notifications.

They’re releasing new inventory every few minutes so you have to watch it in the app and when the button says ‘add to cart’ you have to jump on it and check out really fast. I was able to snag a preorder tonight, got one to put with my husband’s Christmas gifts he’s going to be really excited! I just looked again and now the button says Unavailable so I think you’ll have to check every day maybe multiple times a day.

On the product page on the official Nintendo site, it states "This device has not been authorized as required by the rules of the Federal Communications Commission. This device is not, and may not be, offered for sale or lease, or sold or leased, until authorization is obtained" So until that happens, they can't put it up for sale/pre-order.
