The description says "unlocked" so my guess is that it is , in fact, unlocked. Also, HTC has a warranty program that is independent of third parties such as best buy or cell phone carriers. They offer Uh-Oh protection which offers you a one-time 100% free replacement if you break your phone into a million pieces.
