Water proof and water resistant are different. The marketing jargon will say this but in reality it's only water resistant to a certain depth. This means if you exceed this depth the warranty is void. Since there is no manner to gage that I would assume that's the reason for the warranty clause. This is pretty common on all so called water proof products. I have used mine in the shower, using the hose and other means of dunking it. So far no issues.
