Can you use this phone if you ARE under contract? null

Yes you can use this phone with T-Mobile under contract but to use it with another carrier you would have to have it unlocked first

I was able to take this phone to a T-mobile kiosk in my area and replace another older phone on my plan without change. Its as easy a moving and/or programming the nano SIM for these GSM phones.

Yes I wet my phone that I have with tmobile under contract. I call tmobile and the swap the simple card. Now I used this one on my regular plan

That's exactly what I'm doing. If you already have an active SIM card that's the correct size, just plug it in and you're ready to go. My SIM card from the prior phone was too large, so I installed the prepaid SIM card that came with the phone, didn't power the phone on, and the called T-Mobile support from a different phone and the tech walked me though giving him the SIM card s/n and activated it for my account before having me turn the phone on.
