Dangerous: Inadequate Temp won't get below 40F!

I was throwing out a lot of moldy cheeses and vegetables on a regular basis. I set up 2 different types of properly calibrated thermometers in the fridge - one on the middle shelf and one on the door shelf. I made sure the door was not opened for less than 4 hours. The thermometer is set at 35F, but the interior of the fridge will not go below 40F. Checking regularly, the temp is still consistently running at 40F. This is dangerous. Looking into this problem, I found this to be a very common complaint. The freezer gets to freezing temperature so the unit is certainly capable of maintaining a proper refrigerator temp and yet it won't get to 35F. My unit is no longer under warranty, but I consider this to be actually a defect.

It seems to hold the temperature consistently, but the shelf arrangement is hard to make work for the bottles I want to store upright. I like that it can be operated as a full refrigerator.

We put a thermometer inside the fridge to see how accurate it was based on the temperature it was set at and it was spot on. Can't say enough good about it.
